Job Description

3 months contract with local authority

Job Purpose:

To provide leadership and expertise in managing tribunal and formal disagreements related to SEND services. This includes preparing and presenting cases ensuring early mediation and problem resolution and engaging with various stakeholders to promote best practices and continuous service improvement.

Main Duties and Responsibilities:

  1. Leadership for Tribunal and Formal Disagreements:

    • Prepare cases for tribunal liaise with Legal Services SEND services and multiagency practitioners.
    • Represent the Local Authority in legal environments presenting cases at SEND Tribunal (SENDT) and defending proposed service provisions.
    • Prepare evidence for the Local Government Ombudsman.
  2. Mediation and Problem Resolution:

    • Ensure mediation and problem resolution are active features early in caseworkers engagement with families to reduce tribunal numbers.
  3. Resolution Meetings:

    • Provide advice on and attend resolution meetings with parents and other practitioners to settle disputed issues without formal legal redress.
    • Negotiate changes to EHC plans.
  4. Engagement with Schools and Agencies:

    • Develop awareness and understanding of best practices in assessment planning and personcentred approaches.
  5. Workforce Development Strategy:

    • Work with team managers to identify manage and resolve practice concerns.
  6. Respond to Concerns:

    • Address concerns raised via the SENDT process and through formal and informal mediation and disagreement resolution meetings.
    • Develop capacity and confidence in the SEND Team and across the local area partnership.
  7. Point of Contact:

    • Act as the main point of contact for parents carers or young people who lodge an appeal with SEND Tribunal or request mediation/disagreement resolution.
    • Engage with schools witnesses and legal representatives.
  8. Coordination and Record Keeping:

    • Coordinate matters keep clear records and keep all parties updated at every stage.
    • Provide quantitative and qualitative reports and briefings to inform good working practices and service improvements.
  9. Policy Contribution:

    • Use management information and data to contribute to policies that improve service efficiency and effectiveness.
    • Ensure consistency in decisionmaking through EHC assessments plans and annual reviews.
    • Support effective recordkeeping in the SEND Team to ensure data integrity.
