Job Description

Roles and responsibilities

  • Bachelor Degree in Law
  • Professional legal qualification or certification preferred
  • Excellent English and Arabic language skills (written and spoken)
  • 5 – 7 years similar experience dealing with legal matters in a company of similar size

Responsibilities

  • Provides legal advice on all types of matters related to the Company's business within and outside the State of Kuwait.
  • Liaisons with tenants, investors, third parties, various regulatory bodies, semi-governmental and governmental authorities, as and when requested.
  • Prepares and reviews litigation briefs filed by or against the Company.
  • Attends, as and when required, police and/ or court proceedings to ensure the Company's interests are properly represented.
  • Assists in preparation and review of defence synopsis and necessary documentation on cases launched by or against the Company and follows up with external law firms.
  • Participates in negotiations with the reporting manager and third parties for concluding business transactions.
  • Prepares legal notices, responses and other type of correspondence.
  • Prepares and assists in drafting petitions and memorandum of defences. Assists in corporate legal affairs (i.e. company registration and renewal matters, safe keeping of company records, drafting minutes of General Assemblies/ Board Resolutions, authentication of legal instruments. etc.).
  • As and when required, undertakes any additional task(s) to support the Company in achieving its business plan.
  • Follows-up with case laws and executive orders with external law firms. Follows-up on executive orders and legal judgements and the necessary actions that are required.
  • Takes all necessary steps to prepare power of attorney documents and attestation of Company's contracts.
  • Provides any legal assistance required by the Company during the GSM's process.
  • Drafts and reviews contracts. letters, notices and other legal documentation in coordination with the reporting manager.
  • Drafts renewals/ amendments of contracts.
  • Provides legal advice and opinions to the User Departments on different matters. in coordination with the reporting manager.
  • Continuously monitors/ follows-up with the legal service providers on the legal status of the cases outsourced/ or any other related matters. as and when required.
  • Takes all appropriate measures to defend the Company in case of legal disputes.
  • Ensures all communication by the external legal service provider is in writing and filed appropriately in the respective case file maintained by the Department for future reference.
  • Ensures business operations of the Company and its services are legally valid transactions and comply with applicable laws in force.

Desired candidate profile

1. Legal Research and Analysis

  • Conducting Research: Perform in-depth legal research on various topics, such as laws, regulations, case precedents, and legal trends, using legal databases and resources.
  • Analyzing Laws and Regulations: Interpret and analyze laws, rules, and regulations that impact the organization or client’s business. Provide insights and recommendations based on research findings.
  • Case Analysis: Review case law, statutes, and other legal documents to determine how they apply to a specific case or legal matter.

2. Drafting and Reviewing Legal Documents

  • Document Drafting: Prepare and draft legal documents such as contracts, agreements, memorandums, letters, and policy statements.
  • Reviewing Contracts: Assist in reviewing, editing, and finalizing contracts and agreements to ensure they comply with relevant laws and protect the interests of the organization or clients.
  • Compliance Review: Ensure that all documents and agreements comply with relevant regulations, policies, and industry standards.

3. Contract Management

  • Contract Negotiation: Assist in negotiations related to contracts, working closely with legal teams, clients, or external parties to reach favorable terms.
  • Contract Monitoring: Track the status of contracts, ensuring deadlines, renewal dates, and compliance with terms are met.
  • Risk Assessment: Identify potential risks or legal issues in contracts and provide advice on how to address them.

4. Compliance and Regulatory Support

  • Regulatory Compliance: Ensure that the organization or client is in compliance with applicable laws and regulations, including industry-specific standards, data protection laws, and financial regulations.
  • Compliance Audits: Assist in conducting internal audits or assessments to ensure legal and regulatory compliance.
  • Advisory Role: Provide legal advice to internal teams or clients on compliance issues, helping them avoid legal pitfalls and stay compliant with changing regulations.
