The Court of Protection solicitor will be responsible for providing legal advice and representation to clients involved in matters related to mental capacity and decisionmaking. The solicitor will handle cases within the Court of Protection advocating for individuals who lack capacity and require assistance in their personal and financial affairs.
Key Responsibilities:
Client Representation:
- Represent clients in the Court of Protection in matters related to health welfare and financial decisions.
- Provide legal advice and guidance to clients and their families regarding mental capacity issues.
Case Management:
- Manage a caseload of Court of Protection cases ensuring all aspects of the legal process are handled effectively.
- Draft legal documents including applications witness statements and court submissions.
Legal Research and Compliance:
- Stay abreast of changes in legislation and case law related to mental capacity and Court of Protection matters.
- Ensure compliance with legal and ethical standards in all aspects of client representation.
Client Communication:
- Communicate effectively with clients keeping them informed about the progress of their case and explaining legal matters in a clear and understandable manner.
Collaboration:
- Work closely with other legal professionals healthcare professionals and relevant authorities to ensure comprehensive support for clients.
- Collaborate with the legal team to share knowledge and expertise in Court of Protection matters.
Advocacy:
- Attend court hearings and represent clients effectively in the Court of Protection.

Requirements
- Qualified solicitor with a valid practicing certificate.
- Experience in Court of Protection work with a strong understanding of mental capacity issues.
