En tant que conseiller(e) juridique litiges chez la compagnie votre r le sera dassister dans la supervision des litiges et des contentieux de lentreprise. Cela inclut la gestion des proc s arbitrages m diations et autres proc dures judiciaires impliquant la soci t ses entit s affili es et ses filiales.
Vous aurez pour principale mission de diriger et de r soudre un ventail de conflits notamment en mati re de propri t intellectuelle de contrats de droit du travail de r clamations pour accidents du travail de recours collectifs denqu tes gouvernementales etc. tout en supervisant le travail des avocats externes.
Vous veillerez la conformit r glementaire de lentreprise la r duction des risques et au respect du budget l gal.
Ce poste est plac sous la responsabilit directe de la Directrice des litiges et enqu tes.
RESPONSABILITES
- Agir en tant que principal interlocuteur pour la gestion des litiges de lentreprise y compris la m diation larbitrage et les autres formes de r solution de conflits.
- tre le point de r f rence pour la Directrice des litiges et enqu tes.
- laborer des strat gies de r solution des litiges et des contentieux.
- Faciliter la communication des orientations et des directives entre les divisions commerciales de lentreprise et les conseillers juridiques externes.
- Participer activement la gestion et au traitement des documents y compris les requ tes associ es leDiscovery.
- Superviser les conseillers juridiques externes notamment pour la n gociation des budgets la fixation des honoraires et des provisions ainsi que pour la r vision et l valuation des factures li es aux litiges.
- Contribuer l laboration dun rapport trimestriel sur les litiges les provisions et les audits pour le conseil dadministration concernant les litiges notamment ceux lient la propri t intellectuelle
- Gestion et actualisation r guli re des archives de lentreprise ainsi que des politiques et proc dures relatives la gestion de linformation.
- Traitement des convocations judiciaires et des requ tes gouvernementales dacc s linformation.
- Fournir des conseils juridiques en mati re de droit du travail et de droit de lemploi selon les besoins.
- Participation active aux enqu tes internes pour assurer la conformit r glementaire.
EXIGENCES
- Titulaire dun Baccalaur at en droit et membre en r gle du Barreau du Qu bec ou de lOntario.
- Justifiant dune exp rience significative de 4 6 ans dans le domaine du litige acquise au sein dun cabinet davocats de renom ou dune entreprise majeure op rant dans un secteur fortement r glement .
- Expertise av r e dans la gestion de dossiers de droit commercial et de responsabilit des produits particuli rement dans lindustrie pharmaceutique; la connaissance en droit de la propri t intellectuelle constitue un atout suppl mentaire.
- Aptitude valuer et communiquer clairement les implications pratiques de diverses strat gies et options juridiques.
- Capacit travailler efficacement en autonomie ou en collaboration au sein dune quipe.
- Comp tences exceptionnelles en mati re de recherche de r daction juridique et danalyse.
- Leadership prouv avec la facult dinfluencer les parties prenantes internes et externes et de diriger les processus d cisionnels.
- Comp tences en gestion supervision et coordination notamment dans le suivi des dossiers confi s des tiers.

ABOUT OUR CLIENT THE TEAM AND THE ROLE

In this role you will oversee the management of litigation arbitration mediation and other forms of dispute resolution involving the company and its related entities. Your primary duties will include the effective oversight and resolution of various legal disputes encompassing areas such as intellectual property contractual issues employment law workers compensation class actions and governmental inquiries through the strategic direction and supervision of external legal counsel. It is imperative that you ensure the organization adheres to compliance standards minimizes exposure to risks and operates within the allocated legal budget. Your direct report will be to the Director of Litigation and Investigations.
ROLES AND RESPONSIBILITIES
- Facilitate the oversight of corporate legal disputes including intellectual property class actions commercial agreements employment issues workers compensation and governmental inquiries and investigations impacting the organization and its related entities.
- Serve as a key advisor to the Director of Litigation and Investigations.
- Develop strategies for litigation and dispute resolution.
- Coordinate communication between the organizations departments and external legal advisors providing direction and instruction.
- Oversee the handling and response to requests for document production and eDiscovery.
- Supervise external legal services negotiating cost structures fee arrangements and engagement terms as well as evaluating related billing documentation.
- Contribute to the creation of quarterly reports summarizing litigation activities financial reserves and audit and board communications inclusive of Intellectual Property Litigation.
- Offer insights and recommendations regarding initial legal filings.
- Advise on potential settlements and resolutions when deemed suitable.
- Monitor legislative and judicial developments evaluating their impact on specific business sectors.
- Perform legal research formulate legal opinions and present findings to relevant business divisions.
- Cultivate robust relationships with business partners through proactive communication and by gaining an indepth understanding of the specific business areas.
- Administer the organizations document retention and information governance policies.
- Address legal orders and governmental requests for information.
- Provide counsel on employment and labor law matters as required.
- Assist with internal regulatory compliance investigations / reviews.
QUALIFICATIONS
- Bachelor of Laws and member in good standing of the Bar of Quebec or Ontario.
- Significant experience of 4 to 6 years in the field of litigation acquired within a renowned law firm or a major company operating in a highly regulated sector.
- Proven expertise in the management of commercial and product liability files particularly in the pharmaceutical industry; knowledge of intellectual property law is an additional asset.
- Demonstrate robust business and legal acumen.
- Capable of critically assessing and conveying the practical implications of various legal approaches and decisions.
- Exhibits proficiency in working autonomously as well as collaboratively with team members.
- Possesses superior research drafting and analytical abilities.
- Exhibits influential leadership qualities capable of guiding internal and external stakeholders through decisionmaking processes.
- Skilled in supervisory coordination adept at managing assignments outsourced to external legal counsel.
- Adaptable and agile with a readiness to thrive as a leader in a dynamic and fastpaced setting.
- Proven experience in formulating legal strategies aligned with corporate objectives.
- Established history of developing systems and methodologies for efficient litigation management and reporting.
