Graduation from an accredited law school AND bar membership (license to practice law) in any state in good standing o The Hearing Officer 3 is responsible for preparing and conducting quasi-judicial, administrative hearings and rendering a written decision at the conclusion of the hearings. The decision rendered is a final appealable decision in Unemployment Insurance, Public Assistance, and/or Tax and Labor Disputes. The Hearing Officer 3 is responsible for handling appeals in over 35 different programs. The Hearing Officer 3 will review case files in advance of the hearings, review and decide subpoena requests, and review and decide postponement requests. The Hearing Officer 3 will provide a fair and impartial due process hearing, at which often times parties are unrepresented by attorneys. The Hearing Officer 3 s role at the hearing includes but is not limited to: taking testimony and evidence, responding to objections, developing a complete legal record and ensuring that due process rights are afforded to all parties, performing legal analysis, weighing and appraising testimony and evidence to determine operative facts, applying due process and pertinent legal authority to make a final decision, and complying with Department of Labor and other governing authority requirements. The Hearing Officer 3 is also responsible for drafting and rendering clear, succinct, thoughtfully reasoned and legally correct written decisions within very short and strictly mandated deadlines. They are also responsible for oral communication, in accordance with ex parte rules to parties, including laypersons, regarding submission of evidence, burden of proof, administrative procedures, appeals process, and other clarifying information, and documenting such communication for the case-record. Hearing Officer 3s also work on special projects at the direction of their supervisor or the Chief of the Office of Appeals and participate in continuous improvement efforts.
